TRUSTEE PERMIT GENERAL APPLICATION
A Trustee Permit is required for all work listed below. No work or other activity covered by a Trustee Permit may be undertaken before the Trustees have granted their approval. Applicants must carefully review the Trustees Rules and Regulations prior to completing and submitting a General Permit Application (found below and on the 'Links' page of this website). A Trustee Permit Application must be submitted for all of the following: Repair, replacement, or renovation of existing bulkheads,docks,stairways,revetments, pilings or other structures. Dune or beach replenishments, restorations, grading, filling or other beach work. Phragmite removal and beach grass or other plantings. Dredging, excavation or grading. All fencing, sandbag placement and stairways also require Trustee approval.There may be other activities that require a Trustee permit.

SHORELINE FENCE PERMITS
A Trustee Permit General Application form must be submitted for installation of all fencing on Trustee beaches. Erosion control shoreline fencing installed on ocean-beach properties must be removed by March 15th.
Property owners are responsible for removal of damaged fencing and removal upon the end of the permit period.
Violators without Trustee Permit are subject to fines and the costs of removal. Applicants should also determine if permission is required from any other agency.

BULKHEADS
A Trustee Permit General Application must be submitted for all bulkhead repair or replacement projects.
New bulkheads are not permitted except in extreme cases of imminent danger to structures on upland property.
Replacement behind an existing bulkhead is generally permitted.
Applicants should also determine if permission is required from any other agency.
Violators that repair or replace a bulkhead without a Trustee Permit are subject to fines and the cost of removal.

BEACHING OF SMALL BOATS
Small unpowered vessels, such as canoes, tenders, sailfish, hobie cats, etc. may be placed on any Trustee beach from April 15th to November 1st of each year with the following conditions:
1) Boat shall not impede the public in transit to the water or along the beach. 2) Boat must be completely out of the water at high tide and be properly secured. 3) BOAT SHALL NOT BE PLACED ON BEACH GRASS OR ANY VEGETATION ON THE BEACH. 4) Boat shall not be placed on any designated bathing beach.
If boat is left on the beach after November 1st, it will be placed in a designated impound area within the Town of East Hampton and a fee in the amount of $250.00 per boat will be charged for release of said boat. The boat owner should contact the Trustee office to make arrangements to pay fee and have boat released.
NOTE: The storage of small boats on the racks at Louse Point (Accabonac Harbor) and Settler's Landing (Three Mile Harbor) is by permit only. Please contact the Trustee office at (631)267-8688 and leave your name, phone number, and mailing address to be included on a list for a lottery that will be held each year in March.
There are currently 50 permits issued at Louse Point and 25 for Settler's Landing.
Selected participants will receive a permit application form by mail following the lottery.
Fees: Louse Point (Accabonac Harbor) and Settler's Landing (Three Mile Harbor) $150.00 per boat.
Limit one per person and/or family per year.

VEHICLE PERMITS
BEACH PARKING PERMITS
The Trustees do not regulate parking at local beaches. East Hampton Town beach parking permits may be obtained from the Town Clerk's office located at 159 Pantigo Road.
East Hampton Village beach parking permits may be obtained at the Village Hall located at 86 Main Street.
Please note that Town parking permits are not valid at Village beaches, and Village permits are not valid at Town beaches.
State and County beaches additionally have their own permitting systems.
BEACH DRIVING PERMITS
East Hampton resident beach vehicle permits are available to residents at no cost. They can be obtained at the Town Clerk's office located at 159 Pantigo Road.
Non-residents must pay an annual fee.
It is a violation of East Hampton Town Code to drive on the beach without a Town permit and violators are subject to fines and loss of beach driving privileges.
Applicants must have a valid driver's license, proof of liability insurance,a current vehicle registration, and current inspection sticker. They must carry a towrope or chain, jack, and spare tire.
The permit must be displayed on the back bumper of vehicle.
Permits are valid on the beaches within East Hampton Town and Village, outside of the State and County Parks.

MASS GATHERINGS
The Trustees require a written letter of for any event on the beach that requires a Town mass gathering permit. The letter should indicate the place, date, time of event, the number of people, and importantly, whether the event plans to install structures such as a tent, dance platform on the beach during the event.
Any structure requires a Trustee permit.
The Town of East Hampton requires a mass gathering permit for any event on the beach that includes 50 people or more.
Mass gathering permits may be obtained from the Office of the Town Fire Marshal at 300 Pantigo Place-Suite 111, East Hampton.

PROTECTION OF ENDANGERED SPECIES IN THE TOWN OF EAST HAMPTON
It is prohibited in the Town of East Hampton to disturb or endanger in any way the bird protection areas on the beaches.
The common tern, least tern, roseate tern, and piping plovers are all endangered species and are protected by New York State law from any harassment. The piping plover and roseate tern are also protected under the Endangered Species Act and thus by Federal law. Other species, including certain endangered plants, are also protected by New York State Laws.
Defacing or the removing of wildlife signs will result in a penalty up to $250.

Bottom Lands And Intertidal Zones

DREDGING / EXCAVATION
A Trustee Permit General Application form must be submitted for all dredging or excavation projects.
Maintenance dredging and excavation is generally permitted.
In addition to the Trustee application, applicants should determine if permission is required from any other agency.
Any proposed project may not be undertaken without obtaining a Trustee permit.
Violators are subject to fines.
Application Fees: $75.00 for the first application and $50.00 for one renewal, plus $7.50 per cubic yard of dredged/excavated material. $200.00 minimum fee.

DOCKS
As per Trustee resolution #22 of 1984, the Trustees adopted a policy prohibiting the construction of any new piers or docks, fixed or floating, in the following bodies of water within their jurisdiction: Accabonac Harbor, Georgica Pond, Georgica Cove, Hands Creek (Three Mile Harbor), Hook Pond, Napeague Harbor, Northwest Creek, and Wainscott Pond.
On December 8, 1987, said resolution was amended by resolution #157 to include Hog Creek, and that portion of Three Mile Harbor lying south of the line extending from the northeast corner of Suffolk County Tax Map Parcel #300-92-6-1 (on the west side of Three Mile Harbor) eastward to the northwest corner of Suffolk County Tax Map Parcel #300-94-6-1 (on the east side of Three Mile Harbor at the south end of Will Curl Highway).
Only replacement in kind and in place shall be permitted for marinas lying south of the said line in Three Mile Harbor.
By resolution #46/91 an amendment to the Three Mile Harbor dock policy was altered to allow for extensions to existing docks in circumstances where the public will not be impeded, and there will be a minimal effect on the environment.
A Trustee Permit General Application must be submitted for all dock repair or replacement.
Proposed projects to repair or replace a dock must not be undertaken without first obtaining a Trustee permit.
Violators are subject to fines and the cost of removal.
Applicants should also determine if permission is required from any other agency.
Fees: $75.00 for the first application and $50.00 for one renewal.

ANNUAL DOCK AGREEMENTS
Dock Agreements for all legally recognized structures are sent to upland owners annually by the Trustee office. The Trustee Dock Agreement describes the location and size of the structure located on public bottomlands.
Annual Inspection Fees:
Private structures: $2.00 per linear foot Commercial structures: $3.00 per linear foot Pilings: $10.00 per piling Stairways/Other Structures: $3.00 per square foot
Minimum: $50.00

Duck Blinds
|
DUCK BLINDS
One permit, per person, per body of water will be issued each season.
A Trustee Duck Blind Permit Application must be submitted every year with the following information:
1) An updated copy of the applicant's driver's license. 2) Proof of residency if local address is not on driver's license. 3) A photocopy of the applicant's New York State Hunting License.
Additional requirements for both staked and floating blinds are: 1) All duck blinds must be installed by October 15th and remain in their permitted location and removed by April 1st in any year. 2) All duck blinds must display the Trustee Permit. 3) All duck blinds must be located no less than 500' apart. 4) There shall be no dwelling, house, public structure, livestock or person within 500' of the prospective line of discharge. 5) Any person charged with a violation of any Town, County, State, or Federal law will automatically have their permit revoked.

Fish Traps And Shellfish Permits

FISH TRAPS
Trustee Fish Trap Permits are issued on an annual basis.
The application must be submitted with an updated copy of the applicant's driver's license and a map indicating location of fish trap.

SHELLFISH PERMITS
A permit is required for the taking of any shellfish or shellfish predator for any person twelve (12) years or over who is a resident or taxpayer in the Town of East Hampton.
Violators are subject to fines and imprisonment.
There are two (2) types of annual permits: 1) A personal (non-commercial) permit, which entitles the holder to take shellfish or shellfish predators for the sole use of the individual permit holder and their family. 2) A commercial permit, which entitles the holder to take shellfish or shellfish predators for use by others.
No person may hold a commercial and personal permit at any one time.
Permits may be obtained at the Town Clerk's office at 159 Pantigo Lane and permittees will be given a copy of the current East Hampton Town Shellfish Ordinance at that time.

Shellfish Tags: First 100 tags are free. Second 100 tags are $10.00 and can be obtained at the Trustees office at 267 Bluff Road in Amagansett.

Lazy Point Leases
|
LAZY POINT LEASE
The Trustees own land at Lazy Point and lease lots.
New leases are issued in March of each year.
A copy of an "Environmental Certificate With Representatives, Covenants and Warranties" will be included with said lease. Both the lease and the certificate must be notarized when submitted with payment to the Trustee office.
Fee: $1,500.00 per lot per year.
There will be a 2% transfer fee of rental or sale of house on Trustee property.

Moorings
|
GENERAL MOORING INFORMATION
All motor boats under 25' and sailboats under 20' may moor in the following areas: Accabonac Harbor, Georgica Pond, Napeague Harbor, Northwest Creek, Three Mile Harbor (outside the designated areas reserved for boats over 25').
All motor boats over 25' and sailboats over 20' are to be moored in the Large Boat Mooring Area in Three Mile Harbor.
No person shall anchor a boat for more than four(4) hours at night in Trustee waters except in the designated overnight anchoring zone in Three Mile Harbor.
A Trustee mooring permit application must be submitted with the following: 1)An updated copy of driver's license. 2)An updated boat registration, documentation or bill of sale (for boats 15' or less) 3)The appropriate fee due.
All documentation must be in the name of the applicant for the mooring. Any permit issued by the Trustees shall be for the exclusive use of the permit holder of a specific vessel therein stated and such permit shall not be transferable to another person, or to another space, or to another vessel.
Boat owners will provide their own mooring equipment (anchor, chain, rope & buoy). All boats and mooring equipment are to be removed from Trustee waters by December 1st of each year (with the exception of commercial fishing boats).
Mooring permit renewal applications are mailed out in January.
In addition to providing for seasonal moorings, the Trustees provide a limited number of moorings for the use of transient vessels visiting Three Mile Harbor.
The East Hampton Town Harbor Master and Trustee Pump-out Boat Operators manage the day to day use of these moorings. These transient moorings are installed by Memorial Day.

As of January, 2013 renewal mooring permit holders in all locations will have priority over new applicants provided the applications are received by March 31, 2013. After March 31st, permits will be issued on a first come, first serve basis.
No moorings will be set before April 1, 2013 and must be set by June 1, 2013. All moorings (bottom anchorage and stakes) shall be removed by December 1, 2013. There will be no winter stakes or buoys. Moorings not removed by December 1st will be subject to removal by the Trustees.

Commercial License required. Commercial Fishermen: $100.00- 1st mooring $50.00- 2nd mooring Note: Two moorings per commercial applicant are permitted.

Discount as per Mooring Instructions: To receive a discount, applicant may submit their most recent tax return as a commercial fisherman, or receipts for sale of fish.

The following roads are under Trustee jurisdiction.
Old Two Holes of Water;Buckskill Road(section); Edwards Hole Road;Edwards Hole road (north section); Wainscott-Northwest Road (north section); Six Pole Highway; Ancient Highway; Old Sag Harbor Road; Barnes Road; Crooked Highway; Two Rod Highway (section); Blind Highway; Middle Highway (between Springy Banks Road & Hands Creek Road); Middle Highway (south of Stephen Hands Path); Middle Highway (Hump Path);Cross Highway to Northwest Road (Midland Highway or Grassy Hollow Road); Old Montauk Highway; Lazy Point Road (sections); Napeague Beach (un-opened sections) and Pass Road (Passing Road).

Note that many Trustee-owned parcels are scattered throughout the Town and Village and are not listed above.

ACCESS EASEMENTS
Access easements will be granted over public roads managed by the Trustees only when no other access is possible.
Access easements will require that a quit claim deed to the roadbed be submitted to the Trustees by the adjacent lot owner (applicant).
Since the Trustees prefer that the Trustee roads remain in their natural state, access easement will only allow the Trustee road to be improved to private lane specifications and utilities may be installed without further approvals.
Improvements beyond private lane specifications will require additional approval by the Board of Trustees. The maximum cleared width will be 22 feet, as per private road standards. All applicants are required to furnish, at their own expense, a current survey of the Trustee road where the access is to be granted.
Trustee roads are not part of the Town Highway Department system. All Trustee roads are to be maintained by adjacent lot holders.
